The New York State Scaffold Law places "absolute liability" for scaffold injuries on contractors and property owners. In other words, the injured worker is guaranteed a settlement and is not held liable for any negligence or failure to use provided safety equipment. Because of this, lawsuits have increased (despite the fact that injuries have decreased) and construction costs and insurance rates have increased. In turn, fewer workers are hired, consumers pay higher prices and the overall economy suffers.
